TCP is an emerging contaminant recently detected in more than 80 water systems throughout California. TCP was an inactive impurity in pesticides that were used on crops in California and other states for decades. The pesticide manufacturers knew TCP served no beneficial purpose in their products, but failed to remove it in order to avoid hazardous waste disposal costs. Now, TCP is classified by EPA as a probable human carcinogen.

On August 21, 2009, the Office of Environmental Health Hazard Assessment finalized a Public Health Goal for TCP in drinking water at 0.7 parts per trillion. An MCL for TCP is expected within the next two years. California water suppliers need to be concerned about TCP and the costs of complying with a potentially stringent MCL.

The good news is that effective treatment technologies exist to treat wells that are impacted by TCP, as do opportunities to recover the full costs of treatment from the pesticide manufacturers responsible for the contamination, rather than from your ratepayers. Sher Leff represents multiple California water suppliers in TCP products liability lawsuits pending in California courts.
